Terms of Service
Effective: July 2026
Important: Orbit is not an emergency service and is not a medical device. It is not a replacement for professional medical care or for calling your local emergency number (911 in the US). In an emergency, always contact official emergency services directly. Do not rely on Orbit as your only means of getting help.
1. Acceptance
These Terms of Service (“Terms”) are a binding agreement between you and Orbit (“we,” “us”). By creating an account or using the Orbit app (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. These Terms match the terms you accept in the app when you first sign in.
2. Who can use Orbit
You must be at least 16 years old to create an account, or the age of digital consent in your country if higher. A parent or legal guardian may add a minor to a family circle (“Nest”) and is responsible for that minor’s use of the Service and for any consent required. By adding another person you confirm you have the authority and their consent to do so.
3. What Orbit does — and does not do
Orbit helps families stay connected by sharing approximate location, sending alerts (check-ins, place arrivals and departures, speed and health notifications), and raising an SOS to your circle. On the Platinum plan, an SOS can also send text messages and place phone calls to your chosen emergency contacts (delivered through our provider, Twilio).
Orbit is not an emergency service and is not a substitute for calling your local emergency number. We do not guarantee that any alert, location, message, text, or call will be delivered, accurate, timely, or received. Location, health, driving, crash, and inactivity features may be delayed, approximate, unavailable, or wrong, and may produce false positives or miss real events, for reasons outside our control (device settings, battery, signal, OS limits, third-party services). These features are informational, are not a diagnosis, and must not be relied upon for medical decisions. In a real emergency, always contact official emergency services directly.
4. Your account and acceptable use
You are responsible for activity on your account and for keeping your device and credentials secure. Provide accurate information and keep it current. You agree not to use Orbit to stalk, harass, harm, or unlawfully surveil anyone; to track a person without their knowledge and consent; to break any law; or to interfere with or misuse the Service. We may suspend or terminate accounts that violate these Terms.
5. Location, health & data consent
Orbit works by collecting and sharing location and, optionally, driving, movement-history, and health information with the members of the Nests you join. You control what you share and may turn any sharing off, or leave a Nest, at any time. By enabling sharing you consent to Orbit collecting and sharing that data for the purposes described here and in our Privacy Policy, which forms part of these Terms. We do not sell your personal data, and we do not share it with third parties for their own use or for research — your information goes only to the family members you choose and to the service providers that operate the Service for us (Section 7).
6. Subscriptions & billing
Orbit offers an ad-supported free tier and optional paid plans (Silver, Gold, Platinum), plus a one-time free trial. Paid plans are auto-renewing subscriptions billed through your Apple App Store account.
- Your subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Manage or cancel anytime in the App Store (Settings ▸ Apple ID ▸ Subscriptions). Deleting the app or your Orbit account does not cancel an Apple subscription.
- A free trial converts to a paid subscription unless cancelled before it ends; starting a paid plan during a trial may forfeit the remaining trial time.
- Except where required by law, payments are non-refundable; refunds are handled by Apple under its policies.
The free tier is supported by non-personalized advertising. Referral credits and promotions have no cash value, are for personal use only, and may be modified or revoked if abused.
7. Third-party services
Orbit relies on third parties to work, including Apple (HealthKit, WeatherKit, and App Store billing), Google (Firebase and, on the free tier, AdMob advertising), and Twilio (Platinum emergency SMS and calls). These providers process data only to operate the Service on our behalf; we do not sell your data to them or to anyone else, and we do not hand your data to third parties for their own use. Your use of those features is also subject to those providers’ terms, and their availability is outside our control.
8. Your responsibilities
Keep your contacts and family circle accurate, grant the permissions the features need, and test that alerts reach your family. You are responsible for how you use the app and the information you share.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, reliability, availability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, Orbit and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on the Service, including any failure or delay of an alert, location, message, or emergency feature. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold Orbit harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or the rights of any third party.
12. Termination
You may stop using Orbit and delete your account at any time. We may suspend or terminate the Service or your access if you violate these Terms or to comply with law. Sections that by their nature should survive (Disclaimers, Limitation of Liability, Indemnification) survive termination.
13. Governing law & changes
These Terms are governed by the laws of your country or state of residence to the extent applicable, without regard to conflict-of-laws rules; nothing here limits any non-waivable consumer rights you have. We may update these Terms as the app evolves; if we make material changes, we will ask you to review and accept the updated Terms in the app before continuing to use the Service.
